Attention: San Francisco Employers

The Commuter Benefits Ordinance

Effective September 21, 2008, San Francisco employers with 20 or more employees will be required to offer a transit program to all employees who work 10 or more hours per week.

While participation by employees is voluntary, San Francisco employers must offer a transit program to their employees no later than is January 19, 2009. If an employer is found to be out of compliance, the employer will be subject to penalties that begin at $100 for the first violation and increase to $500 per violation.

To assist you to comply with this new regulation, we offer the Commuter Choice program.
 

Commuter Choice Plan

 
The Commuter Choice Plan is a tax savings employee benefit plan permitted under Section 132(f) of the Internal Revenue Code. The Commuter Choice Plan was authorized by Congress to help employees pay for the parking and transportation services they require in order to work.
 

The Mass-Transit benefit allows employees to pay pre-tax for up to $115/month* of mass transit and eligible vanpool commuting expenses. Eligible expenses in this benefit are:
  • Transportation by train, light rail or by a public or subscription bus, or;
  • Transportation by eligible vanpool (an eligible vanpool is defined as a vehicle transporting 7 or more adults, including the driver, for the majority of the commute trip).

The Pre-Tax Parking allows employees to pay pre-tax for up to $220/month* for eligible parking expenses:
  • Parking at or near your primary, long-term business location, or;
  • Parking at or near a “park and ride” or similar location if you use mass-transit.
* Contribution limits shown apply to 2008, subject to cost of living adjustments for 2009.
