Privacy Policy

Your privacy is important to us. We do not collect personal information about you from the web unless you voluntarily provide it to us and we collect, process and use personal information only for performing the relevant service selected by you. That information will be gathered when you come onto our site to: provide feedback in an online survey; request product information; request a contact from a FLEXTODAY, INC. representative. The personal information that may be gathered includes your name, fax, telephone number, street address and e-mail address. You may also be asked for further information about yourself such as your job category and your industry type, your company name and job title, and the number of people in your company.

We will use best efforts to not transfer information collected from the web that personally identifies you to anyone else without your knowledge and approval at the time it is collected from you. You will also have the opportunity then to indicate whether you wish to decline to receive promotional or marketing material about other products and services of FLEXTODAY, INC. Visitors to our web site: We collect and store only the following information: the name of the domain from which you access the Internet , the date and time you accessed our site and the Internet address of the Web site from which you linked directly to our site. Emails: Please do not send unsecured e-mails to us with personal information. FLEXTODAY, INC. offers several methods and ways to send messages securely but incoming messages to our “general” email addresses, such as flex@ and cobra@ are not secured. This means that personal information sent to us via e-mail to these addresses can be accessed by other users on the Internet. Please do not include any health or claim-related information in unsecured e-mail correspondence. This includes Medicare numbers, Social Security numbers, personal medical information, or other confidential items. If we are unable to determine the source of any e-mail, we will send a return message requesting identification of the sender. Please note that we cannot accept attachments with e-mail correspondence.

Personal information will not be provided to a non-affiliated third party without your prior consent, except as permitted by federal and state law. If you have submitted information about yourself through our Web site and/or e-mail message and would like for us to delete that information from our records, please send an e-mail. We will make every effort to delete your personal information from our files.

This web site includes links to third-party web sites to allow participants and their authorized representatives to view summary information regarding their participation in the Flexible Spending Account and similar programs offered by their employers. Those web sites, including myflexonline.com, have been provided with summary information by FLEXTODAY, INC. regarding the accounting of the accounts of participants in benefit plans for which FLEXTODAY, INC. acts as Contract Administrator. Every effort has been made to protect the privacy of all parties. In no event will specific information regarding any medical issue, condition or treatment of any individual be made available for access on the web.

Upon your request, we will assist you to review, to delete or to correct or update your personal information that you have previously provided. If at any time you believe that we have not adhered to our policy with respect to protecting your privacy, or if you have questions regarding the collecting and/or use of your personal information or regarding our privacy policy, please contact us. We will use all commercially reasonable efforts to promptly address your concern.

If we receive an email with a claim form and/or claims documentation attachment, the email will be permanently deleted from our email server without opening it to protect the sender’s privacy and to avoid any email-related viruses.

Anti-Spam Policy

FlexToday, Inc. has a strict anti-spam policy and you can opt-out of receiving emails from us at any time. FlexToday may send emails from several domain names, including but not limited to FlexToday.com, FlexTodayMail.com and PayCOBRA.com. There are several ways we may contact you by email.

First, as a client of FlexToday, Inc. or a participant in a benefit plan of a client of FlexToday, Inc., we will contact you by email regarding our services and to provide you with updated information on your benefit accounts. These emails will include both our mail and email addresses to allow you to respond and “unsubscribe” at any time. If you do not wish to receive these communications, we will honor your request. However, if your employer provides us with your email address, you may have to ask your employer not to do so in the future or provide your employer with an email address that you would prefer to receive such communications.

Next, if you have subscribed or have been invited to subscribe to the FlexToday Blog (blog.FlexToday.com), you will first have to “opt-in” to subscribe to the blog updates. You will also have the option to unsubscribe or opt-out at any time. Each email you receive will include an opt-out link and your request to unsubscribe will be honored at our earliest opportunity.

Finally, FlexToday, Inc utilizes third-party software, websites and services in the performance of our services to you. Examples of these third-parties include but are not limited to myflexonline.com and eflexonline.com. These third-parties may also send you emails regarding your benefit accounts. If you receive emails from these parties that are inappropriate or unwanted, please forward copies of them to us at flex (at) flextoday.com and we will make every effort to resolve the situation.

Consent To Electronic Signatures

Be advised: By using the MYFLEXONLINE.COM, PAYCOBRA.COM, FLEXTODAY.COM websites you consent to the use of electronic signatures with the related online forms and enrollments. This shall include, but not be limited to, creating and submitting claims, payment authorizations, enrollments and similar documents, both using online web forms and forms and documents in Adobe Acrobat format. You acknowledge that you have the right to have the record provided or made available on paper or in non-electric form, and you have the right to withdraw your consent to the use of electronic signatures. You are aware that such consent to the use of electronic signatures will apply to transactions consummated using the FlexToday.com website, the PayCOBRA.com website and the MyFlexOnline.comâ website. You are aware that you may withdraw your consent to the use of electronic signatures by providing an in-person, non-electronic signed writing withdrawing such consent to FlexToday. You may also obtain a paper copy of any such electronic record by contacting FlexToday and requesting such paper document, although copy expenses may apply. You are aware that you are responsible for all hardware and software reasonably necessary to access the(se) service(s) and the use of the electronic signature function. For the purpose of this Agreement, “Electronic Signature” means an electronic symbol or process attached to or logically associated with a document or record and executed or adopted by you with the intent to sign the record.

Electronic Check Conversion and Check-By-Phone Notice

FlexToday, Inc. utilizes a process called electronic check conversion to handle the processing of payments received. Electronic check conversion is a process in which your check is used as a source of information— for the check number, your account number, and the number that identifies your financial institution. The information is then used to make a one-time electronic payment from your account—an electronic fund transfer (EFT). The check itself is not the method of payment.

If you send us your completed, signed check to us by mail, you authorize us to copy your check and to use the account information from your check to make an electronic fund transfer from your account for the same amount as the check.

If you choose to make a check-by-phone transaction, we will accept your check information from you by phone.

If you send us a copy of our fax using our Check-By-Fax authorization form, you authorize us to use the account information from your check to make an electronic fund transfer from your account for the same amount as the check.

The Electronic Check Conversion, Check-By-Fax and Check-By-Phone options may cause your payment to be withdrawn from your account faster than a normal check, frequently within 24 hours of its receipt.

By presenting us with a check or authorizing us to accept your check by phone, you have also agreed to pay a Non-Sufficient Funds (NSF) fee of $25 if your bank rejects or dishonors your payment due to insufficient funds. If your payment is rejected by the bank, we may resubmit your original check amount plus the $25 fee. If your check is rejected by your bank more than twice in any year, we reserve the right to refuse to accept checks from you and to require another form of payment.

When checks are processed electronically, your rights, remedies, and potential losses are governed by the federal Electronic Funds Transfer (EFT) Act.
